Intended marriage or legal cohabitation with an EU national
A non-EU national who wishes to marry or legally cohabit in Belgium with an EU national and subsequently apply for family reunification, may apply for an entry visa based on Directive 2004/38/EC at the diplomatic or consular post responsible for his/her place of residence, or apply for a D visa if he/she is not a beneficiary of the Directive.
In the first case (entry visa), the applicant must demonstrate that he/she is the partner of the EU citizen within the meaning of Article 47/1, 1° of the Law of 15 December 1980 (de facto partnership). A non-EU national who wishes to marry or legally cohabit in Belgium must apply in person for a D visa at the Belgian diplomatic or consular post responsible for their place of residence abroad.
