Practicalities
The Vulnerable Persons Unit contacts the guardian to make an appointment for the UAM interview at the Immigration Office. A decision may be made not to interview the minor if they are too young or unable to participate in the interview.
The guardian receives an invitation from the Immigration Office with the date and time of the interview and informs their ward. The guardian and the ward, and possibly their lawyer, present themselves at the IO (at the "Cube", Boulevard Pacheco 44, 1000 Brussels) at the precise time indicated on the invitation. They must bring with them the original national and international documents establishing the identity or nationality of the minor and any other documents relevant to the application.
If the guardian cannot attend the appointment, they will inform the Vulnerable Persons Unit as soon as possible so that a new date can be set.
Process
The purpose of the hearing is to gather as much information as possible to determine a durable solution. The official conducting the interview welcomes the young person, their guardian and, if applicable, their lawyer, in a room where confidentiality is guaranteed. They explain the role of each participant and potentially that of the interpreter. The IO official scans the identification documents and/or any other relevant documents and returns them to the guardian at the end of the interview.
The hearing is divided into two parts. The first part focuses on the personal data of the MENA, their parents, family members and acquaintances. The second part is devoted to "free narrative", during which the young person can talk about their situation. It's important that they get to tell their side of the story.
The interview report must accurately reflect the questions, as well as the answers to those questions. Any additions and comments are also included. If the IO official finds contradictions or inconsistencies in the young person's statements, they must share these with the young person and their guardian, and note them - along with the young person's and guardian's reactions - in the report.
At the end of the interview, the report is reread, possibly with the help of the interpreter, and modified if necessary. It is then dated and signed by the IO official, the guardian and the interpreter, if applicable. If the guardian refuses to sign the report, the reasons for the refusal must be indicated. Lastly, a copy of the report is given to the guardian.
