Best Interest Procedure for Unaccompanied Minors (in search for a durable solution)

In accordance with Articles 61/14 and subsequent of the Law on foreigners, the guardian of an unaccompanied foreign minor (UAM) may submit an application for a residence permit for their ward to the Vulnerable Persons Unit of the Immigration Office. This procedure is based on the United Nation Convention on the Rights of the Child (UNCRC) and is characterised by the search for a durable solution for each minor according to his or her best interests.

The IO Vulnerable Persons Unit organises a interview with the UAM in the presence of their guardian and then determines the durable solution based on the information in the file.

If a durable solution is found in Belgium, the IO's Vulnerable Persons Unit is responsible for issuing residence documents until the young person reaches the age of majority or is granted an indefinite stay. In this context, the guardian provides the IO with objective information about the minor's life plan in Belgium, among other things.
