The decision of refusal of entry

If the entry conditions for the Schengen area are not fulfilled then a decision of refusal of entry can be taken.

The legal basis for this can be found:

  • Article 14 of the Schengen Borders Code Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code)
  • Chapter II of the Belgian Immigration law of 15.12.1980

 

The individualized decision of refusal of entry is notified to the person in question and a copy is handed to him/her. The possibilities of appeal against the decision of refusal of entry are also described on the standard form.
